These Terms of Use govern the use of the Clever Eat application, the web version of the application, and all related features and services (hereinafter: “Clever Eat” or the “Service”), operated by Iztoknet Iztok Balažic s.p..
By registering, accessing, or using the application, you confirm that you have read, understood, and agreed to these Terms of Use. If you do not agree with these Terms, please do not use the application.
Clever Eat is an application for tracking nutrition and eating habits. Among other things, the application may allow users to:
The range of available features may change, be expanded, or upgraded over time. Certain features may not be available to all users, on all devices, or in all countries.
Registration of a user account may be required to access certain features. Users must provide accurate and up-to-date information when registering.
Users are responsible for keeping their username, password, and other account access information secure.
An account may not be used in a way that enables unauthorized access to the Service or use of the account by persons who are not authorized to use it.
If a user suspects unauthorized access to their account, they should notify us as soon as possible.
Users agree to use Clever Eat lawfully and in accordance with these Terms.

We reserve the right to restrict the use of individual features if we detect abuse, unusual automated activity, or activities that may threaten the operation or security of the Service.
Clever Eat uses artificial intelligence and other automated systems to recognize food and estimate food quantity, calories, macronutrients, and other meal-related information.
The analysis may be based on a meal photo, a user-provided text description, or a combination of both.
Artificial intelligence results are estimates and are not guaranteed to be accurate.
The system may incorrectly identify a food item, its quantity, preparation method, added ingredients, or portion size. As a result, calorie, protein, carbohydrate, fat, and other nutritional estimates may differ from actual values.
Accuracy may also depend on photo quality, lighting, camera angle, visibility of individual ingredients, and the information entered by the user.
Users are encouraged to review the results and adjust them where necessary based on the food actually consumed.
Clever Eat is not a healthcare, medical, or diagnostic service.
Information, calculations, nutrition suggestions, calorie goals, BMI calculations, meal scores, and other information provided within the application are intended solely for general informational and nutrition-tracking purposes.
They do not constitute medical, dietary, or other professional healthcare advice and should not replace consultation with a doctor, dietitian, or other qualified healthcare professional.
Users with health conditions, allergies, intolerances, special dietary requirements, or other medical conditions should consult an appropriate healthcare professional regarding their diet.
Clever Eat must not be used to diagnose, treat, or prevent any disease or medical condition.
Calculations of calorie requirements, macronutrients, BMI, recommended energy intake, and other values are informational estimates.
Actual individual requirements may vary depending on age, sex, body composition, health status, level of physical activity, metabolism, and other factors.
Users are responsible for the information they enter into the application and for any decisions they make based on the information displayed.
Users may upload meal photos, text descriptions, profile pictures, names, profile descriptions, and other content to the application.
Users confirm that they have the right to use and publish any content they enter or upload to Clever Eat.
Users retain ownership of their content. By uploading content, users grant Clever Eat permission to use that content to the extent necessary to provide the application's features, for example for displaying, storing, processing, analyzing, or sharing the content with users selected by the user.
Users should not upload photographs or other content containing personal information of other individuals without appropriate permission.
Clever Eat may provide features that allow users to connect with other users, add friends, view profiles, share meals, use reactions, likes, and other social features.
Users are responsible for the content they share with other users and for deciding which information and content they make visible to others.
Offensive, unlawful, threatening, discriminatory, misleading, or otherwise inappropriate content is prohibited.
We reserve the right to remove content or restrict a user account if the content violates these Terms, applicable law, or the rights of other persons.
Clever Eat may offer free access to certain features or a free or promotional trial period for Premium features.
The duration of the free period, its limitations, and applicable conditions are displayed to the user before activation.
Free features, restrictions, and promotional trial periods may change over time.
Clever Eat may offer paid Premium subscriptions that provide access to additional features.

The final price, currency, taxes, subscription duration, and any promotional offers are always displayed to the user before the purchase is confirmed. Prices may vary depending on the country, platform, taxes, or promotional offer.
If the price displayed in the store or on the purchase page differs from the price listed above, the price displayed to the user immediately before confirming the purchase shall apply.
If the subscription is described at the time of purchase as automatically renewable, the subscription will automatically renew at the end of each billing period until the user cancels it.
The amount for the next billing period will be charged through the payment system or provider through which the subscription was purchased.
If a user purchases a subscription through the iOS application or Apple App Store, payment is processed through the user's Apple account.
The subscription automatically renews unless the user cancels it in time through their Apple account settings.
Subscriptions purchased through the Apple App Store must be managed and cancelled through Apple's subscription management system.
For billing, refunds, and other procedures directly managed by Apple, Apple's terms and policies also apply.
Clever Eat may also allow users to purchase subscriptions through its website or through other supported payment providers.
For such purchases, the price, billing period, automatic renewal terms, and cancellation method are displayed before payment is completed.
Subscriptions generally need to be managed and cancelled through the provider or method through which the subscription was originally purchased.
Users may cancel automatic subscription renewal before the next billing date.
After cancellation, users may generally continue using Premium features until the end of the already paid billing period, unless the terms of the applicable payment provider state otherwise.
Deleting the application from a device does not cancel a subscription.
Likewise, deleting a Clever Eat user account does not necessarily automatically cancel a subscription purchased through an external provider such as Apple.
Such subscriptions must be cancelled through the provider through which they were originally purchased.
For purchases made through the Apple App Store or another external store or payment provider, the refund policies and procedures of that provider apply.
For purchases made directly through the website, consumer rights provided by applicable law apply.
Nothing in these Terms limits any statutory consumer rights that cannot legally be excluded or restricted.
Users may request deletion of their user account through the account deletion feature within the application or by contacting us.
When an account is deleted, personal data is handled in accordance with our Privacy Policy and applicable law.
Certain information may be retained for longer periods where required for legal, accounting, security, or other legitimate purposes.
When using Clever Eat, we may process information entered by the user, including account information, meal photos, nutrition information, body weight, goals, and application usage information.

We strive to ensure reliable operation of Clever Eat, but we do not guarantee that the Service will always operate without interruptions, errors, or delays.
Temporary unavailability may occur due to maintenance, upgrades, internet connection issues, third-party providers, servers, artificial intelligence services, or other technical reasons.
Clever Eat is continuously evolving. We reserve the right to add, modify, or remove individual features and to change the design, functionality, or technical requirements of the application.
If a change materially affects a paid Service or users' rights, we will notify users where required by applicable law.
The software code, design, logos, graphic elements, texts, functionality, data structures, and other Clever Eat content, excluding user-generated content and third-party content, are protected by copyright and other intellectual property rights.
Without prior written permission, users may not copy, modify, distribute, sell, license, reverse engineer, or otherwise make unauthorized use of the application or any part of it, except where expressly permitted by law.
Clever Eat is provided as a tool to help users track their nutrition.
To the fullest extent permitted by applicable law, we are not responsible for decisions made by users based on AI analyses, calorie estimates, macronutrient estimates, nutrition suggestions, BMI calculations, or other information provided within the application.
We also cannot guarantee complete accuracy, continuous availability, or the absence of technical errors.
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.
We may temporarily or permanently restrict access to individual features or a user account if the user:
Where possible and appropriate, we will notify the user of the reason before permanently restricting access.
If, under the laws of their country, a user is not old enough to independently accept these Terms or consent to use of the Service, they must use Clever Eat with the permission of a parent or legal guardian.
Clever Eat may use third-party services to provide its functionality, including hosting providers, payment services, app stores, analytics services, notification services, and artificial intelligence technologies.
Individual third-party services may also be subject to their own Terms of Use and Privacy Policies.
For versions of the application obtained through the Apple App Store, Apple's applicable terms also apply, including the Standard EULA where applicable.

We may update these Terms from time to time due to changes in Clever Eat functionality, applicable law, our business model, or other legitimate reasons.
The current version of these Terms, together with the date of the latest update, will always be published on this page.
If changes are material, users will be notified through the application, website, or email where required.
These Terms are governed by the laws of the Republic of Slovenia, except where mandatory consumer protection rules provide otherwise.
We will attempt to resolve any disputes amicably first. Users retain all rights available to them under applicable consumer protection law.
